Apple Sues OpenAI for Trade Secret Theft and Talent Poaching

Apple initiated a significant lawsuit against OpenAI on June 20, 2024, accusing the artificial intelligence company of orchestrating a deliberate campaign to poach talent and steal confidential information. The legal action, filed in a California federal court, centers on allegations that OpenAI has systematically recruited former Apple employees and acquired proprietary data to accelerate its own development, particularly in the realm of consumer hardware.

Court filings reveal a striking statistic: over 400 former Apple employees now work at OpenAI. Apple asserts that this mass migration of personnel was strategically engineered to bypass years of research and development, enabling OpenAI to rapidly pursue its secretive pivot into building physical consumer hardware. The lawsuit specifically names former Apple executives, including Tang Yew Tan, who previously held the position of vice president of product design for the iPhone and Apple Watch, and Chang Liu, a former senior system electrical engineer.

According to the complaint, Liu allegedly retained a company-issued laptop post-departure and exploited an authentication bug to extract dozens of confidential hardware files from Apple's internal networks. Tan is accused of systematically emailing himself proprietary data related to suppliers and internal industry summaries before leaving Apple. The lawsuit further claims that Tan actively coached current Apple employees to bring unreleased parts to OpenAI job interviews for demonstration purposes.

This legal battle signifies a severe breakdown in the previously collaborative relationship between Apple and OpenAI.
