Judge Rules Trump Financial Records Accessible in BBC Lawsuit

A federal judge is currently deliberating on a dispute within Donald Trump's $10 billion defamation lawsuit against the BBC, concerning the broadcaster's request to obtain testimony and documents from three of Trump's family members. Trump's legal team argued in a court filing on Friday that the BBC's attempt to subpoena Ivanka Trump, Jared Kushner, and Donald Trump Jr. is a "politically-driven leverage" tactic. U.S. District Judge Jeffrey Kuntz, who recently inherited the case, has not yet issued a ruling on this specific matter. The trial for the defamation lawsuit had been previously scheduled for February by the prior judge overseeing the case. Court documents did not immediately disclose the reason for the reassignment of the lawsuit to Judge Kuntz, who was appointed to the bench by President Trump. The BBC's efforts to serve subpoenas on Trump's family members have faced challenges. In May, a process server attempted to deliver subpoenas to Ivanka Trump and Jared Kushner at their residence but was reportedly blocked by Secret Service agents who stated they were not authorized to accept such legal documents. Subsequently, a similar attempt to serve Donald Trump Jr. at Trump Tower in New York was also unsuccessful. In response to these difficulties, the BBC filed a motion last week seeking the court's permission to serve subpoenas on the family members via certified mail, rather than through in-person delivery. Trump initiated his lawsuit in December, alleging that the BBC deceptively edited parts of a speech he delivered near the White House on January 6, 2021. The speech was given around the time a mob of his supporters attacked the U.S. Capitol with the aim of disrupting Congress's certification of Democrat Joe Biden's election victory. Trump's suit contends that the BBC combined separate segments of his speech to deliberately misrepresent his intended message. The lawsuit further claims that the BBC broadcast its documentary in close proximity to the 2024 presidential election, describing it as "a brazen attempt to interfere in and influence" the election's outcome to Trump's disadvantage. The BBC's motion seeks to compel testimony and the production of financial records, which Trump's lawyers argue would be overly broad and irrelevant to the core defamation claims. The judge's decision on this motion will significantly impact the scope of discovery in the high-profile lawsuit.
