Trump Administration Barred from Deporting Students for Criticizing Israel, Judge Rules

A federal judge in California has ruled that the U.S. government cannot deport noncitizens, including students, for criticizing Israel's war in Gaza, deeming such actions an unconstitutional silencing of dissent. The ruling, delivered by Judge Noël Wise on Friday, represents a significant legal victory for The Stanford Daily, the student newspaper at Stanford University. The newspaper had previously reported that international students were living in fear of deportation for expressing their views, particularly concerning the conflict in Gaza.

Judge Wise's decision underscores the fundamental importance of the First Amendment, stating that freedom of speech becomes "illusory" if individuals are only permitted to voice opinions that align with the government or its leaders. This ruling builds upon similar legal precedent established nearly a year prior by a U.S. district judge in Boston. That earlier decision found that the Trump administration had violated the U.S. Constitution by targeting noncitizens for deportation based solely on their support for Palestinians and their criticism of Israel's policies and actions.

In her extensive opinion, Judge Wise emphasized that the freedoms of speech and the press are "foundational to America’s enduring democracy." She identified specific constitutional flaws, including violations of free-speech protections and vagueness issues under the First and Fifth Amendments, which led her to invalidate portions of the federal government's deportation provisions. The judge cited instances of alleged retaliation by U.S. immigration authorities in March 2025 against individuals who had expressed views supporting Palestinians and criticizing Israel's conduct. Notably, a growing number of international experts, including those commissioned by a United Nations body, have characterized Israel's actions in Gaza as potentially constituting genocide.

Furthermore, Judge Wise highlighted concerns about retaliation against individuals who had voiced criticism of Charlie Kirk, the co-founder of Turning Point USA, following his assassination in September. The judge expressed a grave concern that such government actions could set a dangerous precedent, warning that "Tomorrow, or perhaps even today, targets may include anyone in the United States who exercises their freedom of speech to simply express opinions the government does not like." She concluded that this "downward spiral is antithetical to our Constitution that recognizes our rights," emphasizing the potential for a chilling effect on free expression across the nation. The ruling directly challenges the Trump administration's broader efforts to use immigration policy to suppress political dissent, particularly on college campuses.
