Thailand SEC Files Criminal Complaint Against Bitkub

Thailand's Securities and Exchange Commission (SEC) filed a criminal complaint this week against the cryptocurrency exchange Bitkub and two of its former directors. The complaint alleges false disclosures were made in relation to a significant cyberattack that occurred in 2021. This attack reportedly resulted in the loss of approximately $50 million in digital assets.

The SEC's filing specifically targets the alleged misrepresentation of information following the security breach. While the exact nature of the false disclosures has not been fully detailed, the action underscores the regulatory body's focus on transparency and accountability within the digital asset sector. The complaint was filed with the Bangkok South Criminal Court, initiating legal proceedings against the individuals and the company.

Bitkub, one of Thailand's largest digital asset exchanges, has faced scrutiny in the past. In 2022, the SEC issued a warning to Bitkub Online Co. Ltd. regarding its handling of customer complaints and its digital asset listing process. The exchange also faced a temporary suspension of its trading services by the SEC in January 2023 due to system issues. The current criminal complaint represents a more severe escalation of regulatory action.

The former directors named in the complaint are Jirayut Srupsrisopa, the CEO of Bitkub Capital Group Holdings, and Sakolkorn Sakavee, the former CEO of Bitkub Online. The legal action against them and the exchange highlights the increasing regulatory pressure on cryptocurrency platforms globally to adhere to stringent disclosure and security standards. The outcome of this criminal complaint could set a precedent for how similar incidents are handled by regulators in Thailand.
