Texas Governor Abbott Threatens to Withhold Funding from Cities Hindering Housing Development

Texas Governor Greg Abbott has declared his intention to propose legislation that would empower the state to penalize cities and counties found to be violating existing state housing development laws. The proposed measure would involve withholding sales tax revenue from municipalities that fail to comply, a significant financial threat aimed at compelling local governments to facilitate new housing construction. Abbott articulated these intentions during a press event held in Round Rock, a city within the Austin metropolitan area, as part of a broader statewide tour focused on addressing housing affordability. He explicitly stated that local government regulations are a primary driver of escalating housing costs and accused some municipalities of actively attempting to circumvent state laws previously enacted to encourage new housing. These prior legislative efforts include Senate Bills 15 and 840, passed in the preceding year, which were designed to curtail certain municipal zoning powers and thereby stimulate the construction of more homes across Texas.

Governor Abbott specifically criticized cities for implementing "costly mandates" and "extra rules" that, in practice, serve to stifle development and inflate building expenses. He provided concrete examples of these burdensome requirements, citing instances where cities have mandated that new multi-family housing projects must reach a height of eight stories, or require the inclusion of "very large swimming pools," and even necessitate the addition of dog parks in areas where there is demonstrably no market demand for such amenities. Abbott posited that these types of stipulations, which add substantial and often prohibitive costs to construction projects, effectively render them economically unviable, preventing their completion. He indicated that these criticisms were likely directed at new regulations recently put into effect by municipalities such as Irving and Grand Prairie, both located in North Texas. The Texas Tribune has reported that several other cities are reportedly adopting similar restrictive measures.

While Governor Abbott acknowledged that certain local regulations, such as setback requirements, height limitations, and cover restrictions, are legitimate and serve valid planning purposes, he asserted that other cities are gratuitously adding superfluous and excessively expensive amenities to development proposals. The governor's proposed legislation has not yet been formally introduced in the Texas Legislature, meaning it is still in its conceptual phase. This initiative is presented as a component of a larger strategic push by the state government to enhance housing affordability throughout Texas. This broader agenda also encompasses considerations for attracting and facilitating data center development, which requires significant infrastructure and housing for its workforce.
