Taylor Swift Wins Lawsuit Over Song Lyrics

Taylor Swift secured a legal victory on August 10, 2023, when a federal judge dismissed a copyright infringement lawsuit concerning her 2014 hit song "Shake It Off." The lawsuit, filed by songwriters Sean Hall and Nathan Butler, claimed Swift had plagiarized lyrics from their 2001 song "Playas Gon' Play." Hall and Butler alleged that Swift's chorus, "'Cause the players gonna play, play, play, play, play / And the haters gonna hate, hate, hate, hate, hate," was too similar to their lyric, "Playas, they gonna play / And haters, they gonna hate."

U.S. District Judge Michael Fitzgerald ruled that the phrases "players gonna play" and "haters gonna hate" were too common and unoriginal to be protected by copyright. In his ruling, Fitzgerald stated that the phrases were "short, common phrases" and that the "heart of the claim is that the defendant allegedly copied public domain snippets that are free for everyone to use." He further elaborated that the lyrics in question were "a common expression" and that the "purported similarities" between the two songs were "not sufficient to support a claim of copyright infringement."

Fitzgerald's decision highlighted that the "Shake It Off" lyrics did not contain enough original expression to be considered infringing. He noted that the phrases used by Swift were "a quintessential theme of the time" and were "part of the public domain." The judge's ruling effectively stated that the alleged similarities were not substantial enough to warrant a trial, thereby dismissing the case against Swift. This legal win comes shortly after Swift's wedding to Travis Kelce, though the judge's decision was based solely on the copyright claims.
