Australian Aged Care Firm Faces Class Action Lawsuit

Arcare, one of Australia's largest aged care providers, is facing a class action lawsuit filed in the federal court. The lawsuit alleges that residents across more than 50 Arcare facilities in four states were illegally charged a daily "additional services fee" as part of a "signature package" between July 2020 and July 2026. These fees were reportedly levied for services such as high teas and exercise classes, even for residents who were immobile, unable to swallow, or cognitively impaired and therefore unable to utilize them.

The class action aims to represent residents who paid for these services despite their inability to participate. The specific allegations include that Arcare embedded these charges within a broader package, making it difficult for residents or their families to identify and dispute them. The legal action highlights concerns about the transparency and fairness of fee structures within the aged care sector, particularly for vulnerable individuals.

Arcare has stated that it is unable to comment on the ongoing federal court case. The lawsuit brings to light potential issues in how aged care providers bill for ancillary services and the responsibility to ensure these services are accessible and relevant to the residents receiving care. The outcome of this class action could set a precedent for how such fees are managed and disclosed in the future within the Australian aged care industry.
